PERSONAL DATA PRIVACY POLICY

“Customer“/”Event Organizer”: refers to the company or entity that subscribes to this Subscription Contract to use the YOUR DAY Application, either occasionally or on a regular basis.

“Guest”: means a natural person authorised by the Customer, via the Administration Interface, to use the Application.

Within the framework of the YOUR DAY WebApp, Customers and Guests are required to communicate personal data to YOUR DAY COMPANION.

YOUR DAY – PERSON RESPONSIBLE FOR PROCESSING in relation to Customers

Who is responsible for processing my personal data?

It is YOUR DAY COMPANION. It is YOUR DAY COMPANION that publishes the WebApp and, to this end, collects my data.

Concerned about the protection of personal data, YOUR DAY COMPANION, undertakes to comply with current regulations and more specifically with the provisions of the French Data Protection Act of January 6, 1978 and the General Data Protection Regulation 2016/679 of April 27, 2016, known as the “RGPD”.

What is the legal basis for this processing?

The legal basis for processing is :

  • contract: in order to enable the WebApp to be properly executed, the personal data communicated by the Customer is necessary.
  • consent: when the customer registers, he/she freely communicates his/her personal data and accepts the processing of these data, by ticking a box;
  • legitimate interest: this is the commercial interest of YOUR DAY COMPANION, which may contact the Customer, in particular to inform him of new offers or improvements to the WebApp.

What is the purpose of my data?

By being stored and hosted, the personal data collected by YOUR DAY COMPANION will enable the Platform and therefore the WebApps to function correctly.

The Customer’s personal data may be used by YOUR DAY COMPANION to send e-mails to inform the Customer of new commercial offers or improvements to the Platform.

When is my personal data collected and what data is collected?

Your personal data is collected at various times:

  • when a customer account is created: email address, first and last name, user name and chosen password;
  • when using the Platform: e-mail address, connection password, telephone IP address, location data, etc.
  • when contacting Customer Service: first and last name, e-mail address.

Who will receive my personal data?

Communication or transfer of data to third parties (other than subcontractors)

Customers’ personal data will not be shared with or communicated to third parties, whether for advertising or other purposes.

Only YOUR DAY COMPANION will be able to send you e-mails.

Subcontractors

YOUR DAY COMPANION works with subcontractors to ensure the smooth running of the Platform.

These are :

  • the service provider responsible for software maintenance;
  • the data host;
  • the e-mail campaign manager;
  • platform payment manager;
  • the manager of statistical analysis based on Platform operating data;
  • the chat manager on the website (help with getting the Platform up and running).

How long will my data be kept?

Personal data (surnames, first names, e-mails, telephone IP addresses, connection logs, connection password, location data) relating to individuals representing the customer in the context of event organization are kept for 6 months after the end of the contractual relationship.

Personal data (telephone IP address, location data, data voluntarily communicated when using the WebApp: photographs, comments in the forum, etc.) are kept for a maximum of 6 months after the end of the event.

What are my rights?

In accordance with the French Data Protection Act n°78-17, dated January 6, 1978, relating to information technology, files and freedoms, as amended (known as the “Loi Informatique et Libertés”), as well as the General Data Protection Regulation n°2016-679, dated April 27, 2016 (known as the “RGPD”), you have a personal right to access, rectify, limit, delete, oppose and port your personal data.

These rights are strictly personal and verification of your identity will be required in order to process your request.

However, these rights may be restricted for legal or legitimate reasons.

You can exercise your rights by writing to YOUR DAY COMPANION Customer Relations Department, 31 avenue de Ségur, 75007 Paris, France, or to contact@yourday-app.com.

In the event of disagreement with the processing of your personal data, you may lodge a complaint online with the Commission Nationale de l’Informatique et des Libertés (CNIL), or by post.

If you no longer wish to receive YOUR DAY COMPANION communications, please inform them at contact@yourday-app.com.

And what about cookies?

A cookie is a file stored on your phone and associated with the WebApp. Each time you visit the WebApp, it is automatically sent back.

In this case, cookies are deposited by YOUR DAY COMPANION or its subcontractors.

they enable :

  • memorize certain data: Customer subscriber ID, WebApp language to improve access;
  • track Visitors’ browsing on the WebApp for statistical purposes;

Some cookies are necessary for the proper operation of the WepApp and cannot be set.

Who is responsible for processing my personal data?

This is the Organizer of the event you have accessed online, following its invitation or by scanning a QR Code.

YOUR DAY COMPANION is only a subcontractor. It is YOUR DAY COMPANION that has enabled the Event Organiser to publish a dedicated service via the WebApp and the various functionalities chosen.

YOUR DAY COMPANION only collects your data on behalf of its Customers (the Event Organizers).

In any case, it can already be stated that one of the legal bases for processing is consent: when accessing the WebApp, the Guest freely communicates his/her personal data and accepts data processing, via a checkbox.

What is the purpose of my data?

By being stored and hosted, the personal data collected by YOUR DAY COMPANION, on behalf of the Event Organizer, will enable the WebApp to function properly.

It is the Guest’s responsibility to contact the Event Organizer to find out how the personal data will be used.

When is my personal data collected and what data is collected?

Your personal data is collected at various times:

  • when the Customer decides to send invitation e-mails to Guests via the WebApp, containing a QR Code and/or password: e-mails may contain a first and last name, in line with the theme of the event;
  • when access to the WebApp is via “registration”, the information required to register is: surname, first name, e-mail address and telephone number, if applicable.
  • when using the WebApp :
    • for the Guest: phone IP address, location data, etc.
    • when the Guest contacts Customer Service: first and last name, e-mail address.

Concerning the Guest’s personal data communicated by the Customer: Before communicating third-party data of a personal nature (email address in connection with an event which may, where applicable, have a political, religious, trade-union connotation, linked to sexual orientation…), it is essential that the Customer has ensured that he has obtained the Guests’ consent to such communication.

Who will receive my personal data?

Communication or transfer of data to third parties (other than subcontractors)

The Guest’s personal data will not be shared with or communicated to third parties, whether for advertising or other purposes.

Only the Data Controller will receive such data.

For further information:

  • connection data (phone IP address) will not be transmitted to anyone;

On the other hand, anonymized connection statistics (which pages are visited most often, at what time of day, etc.) will be communicated to the Data Controller;

  • certain data published voluntarily by the Guest, and under his/her sole responsibility, such as photographs of the event or comments in the guest book, may be communicated by YOUR DAY COMPANION to the Customer, the Organizer of the event. It is the Guest’s responsibility to ensure that this data complies in all respects with the provisions of the General Conditions of Use.

Some of these data may be considered as personal data, but only if the Guest has communicated his or her identity: signature after a comment in the guestbook, or identification of the person in a photograph.

Subcontractors

YOUR DAY COMPANION works with subcontractors to ensure the smooth running of the Platform.

These are :

  • software maintenance provider;
  • the data host;
  • the e-mail campaign manager;
  • the manager of payments on the Platform;
  • the manager of statistics analysis based on Platform operating data;
  • the website chat manager (help with getting the Platform up and running).

How long will my data be stored?

The Guest’s personal data (telephone IP address, location data, data voluntarily communicated as part of the use of the WebApp: photographs, comments in the forum… or data communicated at the time of registration) are stored 6 (six) months after the end of the event, by YOURDAY as subcontractor.

The personal data transmitted to the Data Processor (the “Customer”) is the sole responsibility of the Customer. It is the Guest’s responsibility to contact the data controller to find out how long the data will be kept.

What are my rights?
